Public Notice Pursuant to the Pennsylvania Clean Streams Law, the Pennsylvania Department of Environmental Protection Rules and Regulations, the Surface Mining Conservation and Reclamation Act, and the Bituminous Mine Subsidence and Land Conservation Act as amended, notice is hereby given that Rosebud Mining Company, 301 Market Street, Kittanning, PA 16201 has applied to the Pennsylvania Department of Environmental Protection to amend the existing CMAP # 56841328 and related NPDES Permit #PA0033677 known as Mine 78 for the addition of the Upper Freeport coal seam, the addition of 2,292.1 acres of underground permit area and subsidence control boundary. The revised/additional subsidence control plan area will include 4,643.6 acres of Upper Freeport mineable area and 10,293 acres of Upper Kittanning mineable area. The proposed underground permit expansion area and subsidence control area are located in Adams and Richland Townships, Cambria County. Starting at a point 1240 feet west of the intersection of Weaver Road and Naugle Road in Adams Township, the permit extends 4100 feet north parallel with SR0219, where it turns west and extends 3300 in a general western direction then turns south and extends 1730 feet were it intersects with Birtle Road in Richland Township, then follows Birtle Road 570 feet west where it turns south and extends 3000 feet where it intersects with SR3031 Airport Road. The permit then follows Airport road to Solomon Run Road, then continues along Solomon Run Road to a point 900 feet south west of the intersection with Gallaria Drive. The permit then turns to the south east and extends 3670 feet to a point east of Mount Airy Drive. The permit then extends west 1700 feet where it turns to the south and extends 2835 feet where it intersects with Jim Edwards Drive, the permit then follows Jim Edwards Drive 2700 feet south then turns southwest and then extends south approximately 4240 feet where it intersects with Schoolhouse Road. The permit follows Schoolhouse Road 900 feet to the east then turns and extends south 2880 feet, turns east and extends 3100 feet where it intersects with the existing permit limit. The permit then follows the existing permit north 7370 then northwest 9300 feet then north 5100 feet then northeast 1900 feet to the point of beginning listed above. The described area can be seen on the Geistown, 7.5 Minute Series topographic map. A copy of the application is available for public inspection and copying for a fee, by appointment, at the Cambria County Recorder of Deeds Office, 200 South Center Street, Ebensburg, PA 15931. Written comments, objections, or a request for an informal conference may be submitted to the PA Department of Environmental Protection, District Mining Operations, 25 Technology Drive, California Technology Park, Coal Center, PA 15423, no later than thirty (30) days following the final (4th) publication date of this notice and must include the personÕs name, address, telephone number, and a brief statement as to the nature of the objection(s).
